Exactly, and there's no sense in arguing this point on the internet with people that have the sole purpose of arguing with you to burn time because they are bored.  Bottom line, if I need to use a repeater I will.

Did you sue them for trespassing? I read somewhere that that works

And this is why I have capability of remote monitoring and remote kill.. So people like you won't because im the boss 😅

I think there is a misunderstanding of what an operator is.  In the context of GMRS, the licensee or their immediate family are the 'operators' of the station being used with any given license.  In the context of a repeater, however, the remote operator who's signal is being relayed is not the operator of the repeater. The license holder of the repeater hardware is. The individual who holds the GMRS license is fully responsible for all transmissions made on the system, regardless of who is physically using the radio.  The license is a station license, not a user license.  While there are limits to who can use the hardware, there are no limits to how many radios can be associated with that license. The licensee is the operator who is responsible for the hardware. If it were any other way, no one except the licensee and their qualified family members would be authorized to legally use the repeater. 


By rule, the station operator (the primary license holder) must be at the control point for that station, actively controlling the communications executed on their station. Remote and automatical control are allowed, but that does not transfer the responsibility of the repeater owner.


If you read my "Change My Mind" thread, there is some other information that was published by the FCC as to why they do not require operators to get permission to use a repeater.

Its not possible. With the exception of 18.2-152.4 Computer trespass, all other Virginia trespass laws specifically indicate physical presence on real property. And 18.2-152.4 really relates to cyber crime, they just did a really, really bad job of naming the statute.

I know. I was just poking fun at the heavyweight legal scholars on the forum.

And to be clear, I'm in no way minimizing jamming or taking their side at all. 
But the trespassing argument going on in this thread is absurd.

Exactly! Now you got it since there should be no argument or drama involved, just kill it. Your repeater and your responsibility. Good thing is you were kind enough to put it on GMRS and open it to the public, so that means I'll be using it till you kill it. See how easy life is when we set our ground rules. And it only took a couple sentences.😀
