It pretty much says the only way to have any regulations have the power of law behind them is for the legislature to pass the bill and send it to be signed by the president.  That the administrative state cannot make regulations, enforce them, be judge, jury and prosecutor like they currently do.
    Fcc regulations have the power of law behind them. It's called the Communications Act.

  2. That is true, but doesn’t matter.  The “effective” radiated power (ERP) is the product of the power input to the antenna, times the gain relative to a half-wave dipole.
    Many folks, however, actually believe the actual watts increase. I was trying to clarify thar. I consider your answer above to be valid.

  3. I see the FCC requires transmitters be Part 95 compliant, at least to be sold/labeled for GMRS use. I also see where the FCC limits power to 50w - but I do not see where the amplifier must be Part 95 certified.

    Common sense suggests that if the radio is compliant and the power does not exceed 50w, it’s a non issue.

    Regardless, are you a Junior FCC Agent? If not, I fail to see why you would care…..


    You answered your own question. An amplifier is a transmitter which requires FCC certification.

    I care because I don't want GMRS to turn into 27 Mhz. There are too.many CBers already on GMRS trying to ruin it.

  4. I am assuming he means you aren't getting more actual "watts" from gain which is true.  That's why it's called "Effective" Radiated Power and not True Radiated Power.
    There are no more watts emitting from the antenna. A 25 watt signal is still.25 watts, regardless of antenna design. Gain just indicates how that power is used.

    • Does the FCCs care? According to the FCCs' lack of enforcement, No
    • Do any normal people care? No
    The FCC doesn't assign the FCC ID and certify the radio. The testing labs do. The test report goes on file with the FCC.

    The FCC has later gone and pulled certification on some radios that were later found to be illegal.
